1. FOR EASE OF REFERENCE
“Charterer” refers to the person who charters the yacht & their guests.

2. JURISDICTION + GOVERNING LAW
Your use of the website and these Terms are governed by the law of Singapore and you submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in Singapore.

3. REGISTRATION
You may need to be a registered member to access certain features of our website.
When you register and activate your account, you will provide us with personal information such as your name and email address. You must ensure that this information is accurate and current. We will handle all personal information we collect in accordance with our Privacy Policy available.

When you register and activate your account, your login details will be your registered email and a password that you have picked. You are responsible for keeping these details and are responsible for all use and activity carried out under these details.

4. BOOKING
All bookings will be accepted on a first come first serve basis, subject to availability of the yacht.  All bookings must be made at least 72 hours prior to the date of charter. However we understand circumstances and will try to make an arrangement for you if the yacht is available.

All bookings are not confirmed until payment has been made.

5. PAYMENT
Full payment is required for the booking of the yacht. Payment must be made in full at least 72 hours before booking is confirmed. If payment is not received, your booking will be released.

Payment is non-refundable once invoice has been sent.

Cancellation of booking is not allowed once confirmation has been sent. Cancellation will only be given subject to reasons deeming reasonable. The deposit shall be forfeited in the event of cancellation.

6. CANCELLATION 
“Gotong Royong Pte Ltd” reserves the right to cancel/terminate any cruising or berth charter in the event of any unforeseen circumstances. In such a case, the full deposit amount shall be refunded to the Charterer. You hereby agree to indemnify “Gotong Royong Pte Ltd” against all claims, losses or damages resulting from the cancellation.

“Gotong Royong Pte Ltd” reserves the sole and exclusive right to cancel the charter if the captain in his reasonable opinion declares that the sea or weather conditions are not suitable for the charter prior to the scheduled yacht charter and there are reasonable concerns over the safety of personnel and yacht. The captain of the yacht at all times has full authority over the safety of the yacht and personnel and at any time can terminate such charter and return to the marina where, in the reasonable opinion of the captain, there is reasonable possibility of danger to the yacht and personnel.

Once the yacht has departed the Marina, the charter is considered to have been fulfilled and no cancellations or refunds are provided.
All prices quoted are in Singapore currency (SGD), unless otherwise specified. Yacht charter rates include the use of the vessel, boat captain, crew and fuel and utilities for the agreed duration, unless otherwise specified. Fuel and utilities are usually separately charged for extended charters.

Yacht charter rates are exclusive of food. You may also choose to bring your own drinks at your own discretion. For alcohol consumption, all guest are required to be above the age of 18.

7. DAMAGE 
Smoking inside the yacht is strictly prohibited for safety reasons. A designated smoking area on the yacht will be briefed to the Charterer and his/her guests during the visit of charter. Littering of cigarette buds into the ocean will be fined a sum of $300SGD.

You are responsible for ensuring that you have arranged suitable and adequate personal travel insurance to cover the entire period chartering of our yacht.
You are responsible for ensuring that you and your guests do not cause any damage whatsoever to the chartered yacht during the Entire Period of the charter.
You are responsible for any damage caused to the yacht that is attributed to the acts and/or omissions of you and your guests during the charter period. You agree to indemnify us for all liabilities to the fullest extent permitted by law. Accordingly, you shall not hold us liable for any liabilities, including but not limited to accidents, personal injuries, damages or losses attributed to the acts and/or omissions of you and/or your guests during the period of chartering of our yacht.

8. LATE / NO-SHOW
“Gotong Royong Pte Ltd” reserves the rights to consider the charter as cancelled should the charterer be more than an hour late from the stipulated start time.  No refunds will be given for no-­shows, and the charter shall be considered as fulfilled.
The charterer and guests are advised to be on time. No time compensation will be given for late arrival, and charter timings shall proceed as according to the stipulated timing as agreed upon, and stated on the invoice.

All yacht charters are bound to the terms and conditions as stated on this document. By chartering a yacht from “Gotong Royong Pte Ltd”, you agree to our Terms and Conditions.

9. LANGUAGE + ACCEPTING OF TERMS AND CONDITIONS
Terms and conditions are provided only in English. No translation will be provided by "Gotong Royong Pte Ltd". You may translate the terms and conditions on your own, however, the English version provided will  take precedence over any other language.
To be eligible to use "Gotong Royong Pte Ltd" services, you are required to agree to the terms and conditions listed on the website. Acceptance of terms and conditions are made by any one of the methods:

1. Ticking the checkbox listed "By checking this box you agree to the terms and conditions" where the option is made available.

2. Making payment to "Gotong Royong Pte Ltd"

3. Usage of services provided (Booking made thru "Gotong Royong Pte Ltd" verbally or thru website.)

10. UNACCEPTABLE ACTIVITIES
You must not do any act that we would deem to be inappropriate, is unlawful or is prohibited by any laws applicable to our website, including but not limited to:

1. Any act that would constitute a breach of either the privacy (including uploading private or personal information without an individual's consent) or any other of the legal rights of individuals;

2. Using this website to defame or libel us, our employees or other individuals;

3. Uploading files that contain viruses that may cause damage to our property or the property of other individuals; and

4. Posting or transmitting to this website any non-authorized material including, but not limited to, material that is, in our opinion, likely to cause annoyance, or which is defamatory, racist, obscene, threatening, pornographic or otherwise or which is detrimental to or in violation of our systems or a third party's systems or network security.

5. If we allow you to post any information to our website, we have the right to take down this information at our sole discretion and without notice.
   
   

10. LIMITATION OF LIABILITY
"Gotong Royong Pte Ltd" and it's affiliates will not be liable for:

1. Any direct, indirect, incidental, special consequential or damages which may be incurred by you or your guests.

2. Any loss of profit (Regardless if incurred directly or indirectly), any loss of goodwill and/or business reputation, any loss of data, cost of procurement, cost of procurement of substituted goods or any other intangible losses.

11. INFORMATION
The information on our website is not comprehensive and is intended to provide a summary of the subject matter covered. While we use all reasonable attempts to ensure the accuracy and completeness of the information on our website, to the extent permitted by law, we make no warranty regarding the information on this website. You should monitor any changes to the information contained on this website.

You do not have any legal rights to use any of our photos without consent from “Gotong Royong Pte Ltd.” Legal action will be taken against you.
